Compensation Plans Approved by the Ontario Superior Court


On March 6, 2025, the Ontario Superior Court approved the CCAA Plans of Arrangement (“CCAA Plans”) of the three major tobacco companies in Canada, Imperial Tobacco Canada Limited, Rothmans, Benson & Hedges Inc. and JTI-Macdonald Corp. (the “Tobacco Companies”).

The Court-approved CCAA Plans set out a global resolution to provide compensation to people who smoked cigarettes sold by the Tobacco Companies and who were diagnosed with certain tobacco related diseases across Canada (including Quebec).

$4.119 billion is allocated for the QCAP Plan.

Criteria for Compensation


The CQTS-Blais tobacco class action only applies to certain smokers or ex-smokers who meet specific criteria – called the QCAP Eligibility Criteria.

  1. Has smoked at least 87,600 cigarettes manufactured by Imperial Tobacco Canada Limited, Rothmans, Benson & Hedges and JTI-Macdonald between January 1, 1950 and November 20, 1998.

  1. Has been diagnosed before March 12, 2012 with one of the following diseases:

    • Primary lung cancer (“Lung Cancer”);
    • Primary squamous cell cancer of the throat (larynx, oropharynx or hypopharynx) (“Throat Cancer”); or
    • Emphysema or COPD (GOLD Grade III or IV).

    If you were diagnosed between March 8, 2015 and March 8, 2019, the Pan-Canadian Claimant Compensation Plan provides compensation for certain Canadian smokers or ex-smokers. For more information, click here.

  1. Was a resident of Quebec at the time of diagnosis and is still a resident of Quebec today.

Compensation Plan Amounts


The table below shows the maximum payment amount that can be approved for a Tobacco-Victim who satisfies all the applicable QCAP Plan Eligibility Criteria:

An Individual who meets all the QCAP Plan Eligibility Criteria will be paid for the single QCAP Plan Compensable Disease with which they have been diagnosed that will provide them with the highest amount of compensation from the QCAP Plan.

IMPORTANT

In the event that the $4.119 billion is insufficient to pay the maximum compensation to eligible QCAP Claimants, compensation will be adjusted downwards on a pro rata basis.


Until the QCAP Claim Deadline of August 31, 2026 has passed and substantially all claims have been processed, the pro rata calculation cannot be known. Neither the Claims Administrator nor the QCAP Agent can provide any information regarding the expected future pro rata calculation.
