Compensation Plans Approved by the Ontario Superior Court


On March 6, 2025, the Ontario Superior Court approved the CCAA Plans of Arrangement (“CCAA Plans”) of the three major tobacco companies in Canada, Imperial Tobacco Canada Limited, Rothmans, Benson & Hedges Inc. and JTI-Macdonald Corp. (the “Tobacco Companies”).

The Court-approved CCAA Plans set out a global resolution to provide compensation to people who smoked cigarettes sold by the Tobacco Companies and who were diagnosed with certain tobacco related diseases across Canada (including Quebec).

$2.521 billion is allocated for the PCC Compensation Plan.

Criteria for Compensation


The Pan-Canadian Claimants’ (“PCC”) Compensation Plan will only provide compensation to certain smokers or ex-smokers who meet specific criteria – called the PCC Eligibility Criteria.

Smoker or Ex-Smoker
Estate of Tobacco-Victim
To be eligible, you must be a smoker or ex-smoker who:
  1. Has smoked at least 87,600 cigarettes manufactured by Imperial Tobacco Canada Limited, Rothmans, Benson & Hedges and JTI-Macdonald between January 1, 1950 and November 20, 1998.

    You may use this calculator to help you determine the number of cigarettes you smoked during this time period.

  1. Has been diagnosed between March 8, 2015 and March 8, 2019 (inclusive of those dates) with one of the following diseases:

    • Primary lung cancer (“Lung Cancer”);
    • Primary squamous cell cancer of the throat (larynx, oropharynx or hypopharynx) (“Throat Cancer”); or
    • Emphysema or COPD (GOLD Grade III or IV).

    If you were diagnosed before March 12, 2012, the Quebec Class Action Administration Plan provides compensation for eligible smokers or ex-smokers that reside in Quebec. For more information, click here.

  1. Was a resident of Canada at the time of diagnosis and is still a resident of Canada at the time of submitting a claim.

  1. Was alive on March 8, 2019.

Compensation Plan Amounts


The table below shows the maximum payment amount that can be approved for a Tobacco-Victim who satisfies all the applicable PCC Eligibility Criteria:

An Individual who meets all the PCC Compensation Plan Eligibility Criteria will be paid for the single PCC Compensable Disease with which they have been diagnosed that will provide them with the highest amount of compensation from the PCC Compensation Plan.

IMPORTANT

In the event that the $2.521 billion is insufficient to pay the maximum compensation to eligible PCC-Claimants, compensation will be adjusted downwards on a pro rata basis.


Until the PCC Claim Deadline of September 3, 2027 has passed and substantially all claims have been processed, the pro rata calculation cannot be known. Neither the Claims Administrator nor the PCC Agent can provide any information regarding the expected future pro rata calculation.
